A lien is a legal claim against a property that must be satisfied before clear title can transfer. For investors, liens can delay closings, add unexpected costs, or create acquisition opportunities when other buyers are deterred.
Tax liens arise from unpaid property taxes and take priority over almost all other liens (including mortgages). They accrue interest and penalties, and the taxing authority can eventually force a tax sale. For investors, properties with significant tax delinquency often signal a motivated seller. The delinquent taxes become part of the negotiation — either the seller pays them at closing or you factor them into your offer price.
Mechanic's liens are filed by contractors, subcontractors, or material suppliers who weren't paid for work on the property. They're common on properties where the previous owner started a renovation and ran out of money. Resolution requires paying the lienholders, negotiating settlements, or waiting for the lien to expire (timeframes vary by state).
Judgment liens result from court judgments — lawsuits, divorce decrees, or creditor actions. They attach to all real property owned by the debtor in the county where the judgment is recorded.
HOA liens arise from unpaid homeowners association dues. In some states, HOA liens have super-priority status and can survive a foreclosure.
For acquisition strategy, properties with multiple liens often scare away conventional buyers and inexperienced investors, creating less competition. If the total lien amount plus your renovation costs still leaves adequate margin below ARV, the deal can be excellent. The key is accurate lien discovery (through a thorough title search) and understanding the resolution path for each lien.
Always budget for lien resolution in your deal analysis, and build in a time buffer for unexpected delays in the clearance process.
